Emerytura pomostowa: stanowisko musi znaleźć się w wykazie

Uzyskanie emerytury pomostowej związane jest z pracą wykonywaną w warunkach szczególnych lub w szczególnym charakterze. Nazwa stanowiska odpowiadać musi wykazowi w stosownej ustawie. Tymczasem pracodawcy mają kłopot z ewidencją zawodów.

W bieżącym roku Państwowa Inspekcja Pracy przyjęła ponad 2 tys. skarg związanych z nieumieszczeniem pracownika na liście uprawniającej do uzyskania emerytury pomostowej. Okazuje się, że przepisy nie są precyzyjne, a niekiedy dopiero opinia stosownego urzędu pomaga w ustaleniu, który z pracowników wykonuje swoje obowiązki w szczególnym charakterze lub takich warunkach.

Niechęć pracodawców do wpisywania takich pracowników do stosownej ewidencji wynika częściowo z konieczności odprowadzania dodatkowej składki do ZUS. Ponadto załącznik do ustawy o emeryturach pomostowych dokładnie precyzuje nazwy stanowisk. Rodzaj wykonywanej pracy nie decyduje automatycznie o uzyskaniu prawa do wcześniejszego świadczenia emerytalnego. Związkowcy są więc zdania, że konieczna jest nowelizacja przepisów. Z tą opinią nie zgadzają się przedstawiciele pracodawców.

Niektóre firmy zwracały się z prośbą o interpretację przepisów do Ministerstwa Pracy i Polityki Społecznej.

Warto również pamiętać, że złożenie przez pracownika skargi do PIP wiązać się może z nałożeniem na przedsiębiorcę obowiązku sprawdzenia, czy w miejscu pracy występują czynniki szkodliwe dla zdrowia, a jeśli tak, to w jakim stężeniu. Decyzja Inspekcji uzależniona jest od wyników pomiaru. Kosztami obarczony jest przedsiębiorca.

Dotąd w 248 przypadkach PIP przychyliła się do wniosku pracownika i nakazała wpisanie wykonywanego zawodu do ewidencji pracowników wykonujących prace w szczególnych warunkach bądź charakterze. Odwołania pracowników od niekorzystnych dla nich Inspekcji składać można do okręgowych inspektorów pracy, a w wyższej instancji do wojewódzkiego sądu administracyjnego.

Routine clinical audit should be a requirement for all healthcare professionals as part of being professional . It is a quality control process: I am sure we all want to improve patient care and clinical audit is an important part of doing that. It ought to be a routine part of life in clinic in the Osteopathic Schools, and to continue throughout our practice life. Limiting the Scope of Osteopathic Practice.The more I think about this the more I am convinced that there is no such thing as a Scope of Practice for Osteopathy it is an irrelevant concept.In practice we all have different strengths and interests and I doubt any Osteopath practices the full scope of Osteopathy; we all practice our own (more or less) restricted part of the glorious whole. What matters is that:A. I recognise the limitations of my knowledge and skills;B. I practice safely within those limitations.This is a Personal Scope of Practice, and the theoretical overall Scope of Osteopathy has no relevance at all in practice.Would it be too onerous for each of us to go through a process of considering the limits of our own Personal Scope of Practice as part of the Revalidation process (for example)? I suspect it would not take us very long I suspect we are pretty aware of our strengths and weaknesses in terms of knowledge and techniques, and it might even be a useful exercise to go through in terms of planning CPD activities for the following few years The advantage of a Personal Scope approach would be that it does not risk constraining the profession as a whole or limiting the range of our individual practice, while, at the same time, acknowledging that there are areas of Osteopathic practice that are outside my personal competence.3. Dressing and undressing / Covering up / Intimate areas and chaperonesIn general I think the discussion document is a major step forward but as Ben has pointed out is is still far from perfect.The real issue is whether the patient is comfortable with dressing/undressing, being more or less covered, having their pelvis worked on, etc. This is a matter of us being sensitive to our patients' idiosyncracies. We pride ourselves on our communication skills and our perceptiveness where our patients are concerned, but it is a two-way street: patients have a responsibility to say if they are not happy. We have to give them the opportunity and try to create an environment in which they feel able to speak up, but if a patient refuses to say anything in the treatment and subsequently complains, I think it unreasonable of the GOsC to lay the entire responsibility of a breakdown in communication at the Osteopath's door.There has been, in general, a tendency for GOsC documents to work on the prin*#####*le that Osteopaths have responsibilities and patients have rights, but not the reverse, whereas there should be a balance of both on both sides.
